Contract Amendment for Sungate Design to complete the preliminary design for the Phase 1 of the Morgan Creek Greenway (TIP# EL-4828A)
PURPOSE: The Town has executed a contract with Sungate Design Group to prepare bid documents for Phase 1 of the Morgan Creek Greenway. The purpose of this agenda item is to authorize the Town Manager to execute a contract amendment with Sungate Design to increase the total contract cost by $10,000 to complete the preliminary design and associated bid documents and bid processing.

Council Direction Statement
The Morgan Creek Greenway is included in the Comprehensive Plan and Bicycle Plan as a priority project that advances multimodal travel options and the Town’s efforts toward climate action and race/equity. Information
INFORMATION: The Town has a contract in place with Sungate Design Group to prepare the preliminary plans and associated bid documents to advertise Phase 1 of the Morgan Creek Greenway for bid. Design is 90-percent complete; the flood study is approved, and the CE document is underway. Staff has been notified of the need for subcontractor services to design a retaining wall, anticipated to cost approximately $6,000 to $10,000. This would increase the total contract for design services to just over $190,000.
Approximately $375,000 of Orange County Transit Funds have been allocated to the Town for the Morgan Creek Greenway, the transit funds can be used toward these additional design costs necessary for bidding the project for construction.

Fiscal and Staff Impact
FISCAL IMPACT: The estimated cost of the additional work is approximately $10,000, bringing the total cost of design services to $190,115.20. The Town’s allocation of Orange County Transit tax revenue to the project can cover the additional expense.

Recommendation
RECOMMENDATION: Staff recommends that the Town Council approve the resolution (Attachment A) authorizing the Town Manager to execute a contract amendment with Sungate Design Group.
