PURPOSE: To request that the Town Council authorize the Town Manager to enter into a Global Agreement for Capital and Infrastructure Town with Orange County, GoTriangle and the DCHC-MPO in order to continue to receive transit funds for Town capital projects identified in the 2022 Orange County Transit Plan Update, subject to Town Attorney final review and approval.

The Transportation and Mobility Chapter of the Carrboro Comprehensive Plan speaks to increasing transit services and associated bicycle-pedestrian infrastructure capital projects to support access to transit. Pocket questions are included as Attachment B.

INFORMATION: On <https://carrboro.legistar.com/MeetingDetail.aspx?ID=1088373&GUID=64B42A7D-0932-4141-8174-42CB702EC7DC&Options=&Search=>, the Town Council received a brief presentation on the Orange County Governance Study and new agreements to govern the administration of the Orange County Transit Plan. Three documents were described: 1) a new comprehensive interlocal agreement (ILA) for the three signatory authorities (Orange County, GoTriangle, and the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (DCHC MPO), 2) a policy and procedure document which codifies the processes that the staff working group (SWG) has been following since 2017, and 3) a Comprehensive Participation Agreement (CPA).
The request at the May 2023 Town Council meeting for authorization for the Town Manager to enter into a CPA for the Town was approved.
A fourth document is known as the Global Agreement, with a Global Agreement template for operating services, and a Global Agreement for template for Capital and Infrastructure. The CPA specifies the need for each participating party to execute a Global Agreement by the end of the fiscal year in order to be eligible to receive reimbursements in FY25. In addition, for the Global Agreements to remain current, each party must execute a new agreement every year and when the scope, schedule or funding of any of the projects identified for funding changes.
Town staff has been reviewing the Global Agreement template for Capital and Infrastructure with the Town Attorney and minor edits have been identified. Once these matters have been resolved, the Town will need to execute the agreement to be eligible to receive reimbursement for capital projects programmed to receive Orange County transit revenues.
The Orange County Transit Plan is updated every four years or more often if changes to the financial model warrant. Projects are selected for funding as part of the development of transit plans and involve considerable public input.

Fiscal and Staff Impact
FISCAL IMPACT: There is currently more than $1,040,000 of Orange County Transit funding allocated to the Town for specific capital projects, including by not limited to the South Greensboro Street Sidewalk and the Morgan Creek Greenway, Phase 1. Transit funds can be used toward the 20-percent local match required with federal transportation funds.

Recommendation
RECOMMENDATION: The Town Manager recommends that the Town Council authorize the Town Manager to enter into a Global Capital Funding Agreement for Capital and Infrastructure - Orange County Transit FY2025, upon review and final approval by the Town Attorney. A resolution specifying this action is provided (Attachment A).
