Public Hearing on Conditional Rezoning for Inara Court at 102 and 104 Fidelity Street
PURPOSE: The Town has received an application to rezone 102 and 104 Fidelity Street to R-2-Conditional (R-2-CZ) for the construction of six single-family residential units. Prior to reaching a decision, the Board of Aldermen must hold a public hearing to receive input on a rezoning request.

INFORMATION: In February 2016, the Town received a request from Paul Snow to rezone two lots on Fidelity Street from R-7.5 to R-2-Conditional (R-2-CZ) for the construction of six single-family residential units (the existing R-7.5 zoning would allow three units). A conceptual site plan and illustrative rendering are provided. A draft ordinance for the rezoning is provided and includes a list of proposed conditions that would be binding. An application for a text amendment to the Land Use Ordinance relating to the project has also been submitted, and is under consideration as a separate agenda item. If the text amendment and rezoning are approved, the applicant would follow with an application for a special use permit.

Conditional zoning districts are discussed in Section 15-141.4 of the Land Use Ordinance. Sections 15-324 and 15-325 outline the process and criteria for the Board in making its decision. The rezoning request was presented to joint advisory board meeting on June 2, 2016 and the Economic Sustainability Commission on June 8, 2016. Comments are provided.
FISCAL & STAFF IMPACT: The petitioner has submitted fees and materials for reviewing and processing this request, which includes public hearing notice and advisory board evaluation. Staff time will be necessary for public notice, including mailed notice and public hearing agenda preparation.
RECOMMENDATION:r Staff recommends that the Board of Aldermen consider the resolution (Attachment A-1) finding consistency and the draft ordinance (Attachment B) amending the zoning map.
