Shelton Station CUP, Minor Modification

 

PURPOSE:  Shelton Station LLC, has submitted an application for a minor modification to the Shelton Station Conditional Use Permit.  Shelton Station is a mixed-use commercial/residential development located adjacent to and including 402 N. Greensboro Street. This modification requests that the project be divided into two phases to facilitate issuance of the certificate of occupancy for the commercial building, whose construction is nearly complete.

INFORMATION: The subject property is zoned B-1(G) CZ and contains four parcels for a combined acreage of about 2.65 acres.  These parcels are identified by Orange County PINs 9778877556, 9778877448, 9778879369 & 9778970512.

The Shelton Station Conditional Use Permit, issued on April 2, 2013 authorizes the construction of a two-story, 22,706 square foot of commercial building (proposed Phase 1) along with a four-story multi-family residential building (proposed Phase 2) with 94 dwelling units. See Attachment A for a copy of the recorded CUP and the application for the permit modification.

The CUP modification, if granted, will allow the project to be phased as shown in the attached exhibit (Attachment B).  This phasing plan is in compliance with the applicable provisions of the LUO and does not create any non-conformities.  The applicant’s letter of request is attached (Attachment C). The Town engineer recommends the following condition by adopted to best protect the proposed pervious pavement of the first phase:

                     That, in order to prevent contamination and clogging of the Phase 1 permeable pavement with sediment, an alternate construction access to Phase 2 will be provided on Parker Street with no construction equipment allowed to cross the completed Phase I parking lot.

 

This permit modification can be approved pursuant to the Board authorizing the applicant’s proposed schedule for the second half of the project.  As described in their letter, Shelton Station LLC believes that the second half of the project will commence in 2017, however, staff recommends that a two year period be allowed to adjust for unforeseen circumstances.

 

-Public Hearing.  It is within the purview of the Board of Aldermen to call a public hearing before rendering a decision on the requested changes.  Specifically, with regard to Minor Modification requests, Section 15-64(b) of the LUO states the following: “Unless it is requested by the permit-issuing authority, no public hearing shall be required for such minor modification.”

 

 

FISCAL & STAFF IMPACT: No known fiscal impacts are associated with this application beyond staff time and the typical fees collected from the applicant for processing the application.

 

RECOMMENDATION:r Town Staff recommends that the Board of Aldermen review, deliberate and make a decision regarding the applicant’s request.  A resolution approving the application has been included should the Board choose to approve the request subject to the following condition (Attachment D):

                     That, in order to prevent contamination and clogging of the Phase 1 permeable pavement with sediment, an alternate construction access to Phase 2 will be provided on Parker Street with no construction equipment allowed to cross the completed Phase I parking lot.
