PURPOSE: The purpose of this item is for the Town Council to receive public comment on a request for the voluntary annexation of the 36.7-acre property located along Old NC 86 and known as the Jade Creek development.  An ordinance annexing this property into the Town limits is provided for the Town Council’s use.

The process for annexation of contiguous property is provided for in N.G.G.S. 160A-31 and requires that the municipal board hold a public hearing with published notice.

Information

INFORMATION: The Town has received a petition for voluntary annexation for the 36.7-acre property located along the east side of Old NC 86, known as the Jade Creek development.  The property can be more specifically identified by the information below:

A map showing the property is attached, along with the petition.  The Town Clerk has reviewed the petition and supporting documents and has found them to be complete (attachments B and C).  The property area to be annexed is contiguous to the Town’s municipal boundary; the development is subject to a special use permit-A that was recently approved for a residential subdivision in June 2023.  The annexation is a necessary step before the final plat can be recorded, and individual homes constructed and sold.

Fiscal and Staff Impact

FISCAL IMPACT: The petitioners have submitted materials for review and processing.  Fiscal impacts involve the cost associated with published notice and staff time.  Per state statute, the Town will be responsible for a fire tax reimbursement to the local volunteer fire department, following the completion of annexation process.  The tax reimbursement is estimated to be approximately $1,468 to $1,712, depending on the effective date of the annexation.

Recommendation

RECOMMENDATION: Staff recommends that the Town Council adopt the draft ordinance annexing the subject property into the Town limits (Attachment A).
