INFORMATION: Ballentine Associates has submitted an application for a Special Use Permit-A (SUP-A) for South Green, located at 100, 110, and 120 Two Hills Drive. The property was previously conditionally rezoned to M3-CZ and received a SUP-A on the same night (Agenda materials: Town of Carrboro - File #: 15-0251 <https://carrboro.legistar.com/LegislationDetail.aspx?ID=2330201&GUID=67E0F4C7-A6E8-4DC9-A54C-C954360AB414&Options=&Search=> and Minutes: View.ashx <https://carrboro.legistar.com/View.ashx?M=M&ID=388583&GUID=6649574D-7F5A-4A14-98FE-04DEABA31CFE>). Development proceeded and Lots 1 and 3 were fully developed in accordance with the approved plans. Lot 2 remained vacant for several years until a new conditional rezoning was approved more recently, allowing for residential uses to be constructed within the conditional zone (Agenda materials: Town of Carrboro - File #: 23-166 <https://carrboro.legistar.com/LegislationDetail.aspx?ID=6214460&GUID=F42233F3-90B5-4AE2-9CCE-89409B8C6F70&Options=&Search=>). Subsequent to the approval of the new conditional rezoning for the property, the current SUP-A application was submitted. If approved, the SUP-A will allow for construction of up to 63 dwelling units and 5,300 square feet of commercial space on Lot 2, the remaining vacant lot.
Project review is ongoing and the applicant and their consultant are working towards bringing the plans into full compliance with the Land Use Ordinance in advance of the January 21, 2025 public hearing date. The project will also be presented to the advisory boards during the December 5, 2024 Joint Advisory Board Meeting.

Recommendation
RECOMMENDATION: Town staff recommends that Town Council adopt the attached resolution (Attachment A) setting the public hearing date for January 21, 2025.
