Request to Reschedule the Public Hearing for Land Use Ordinance Text Amendments that would Clarify Regulations for Short-Term Rentals in Single-Family Residences

PURPOSE: The purpose of this item is for the Board of Aldermen to change the schedule for the public hearing on text amendments to the Land Use Ordinance to clarify the existing provisions relating to short-term rentals.

INFORMATION: At the January 19, 2016 regular meeting, staff presented the Board of Aldermen with a draft ordinance, entitled, "An Ordinance Amending the Carrboro Land Use Ordinance to Clarify Regulations for Short-Term Rentals in Single-Family Residences." The Board set the public hearing for February 23rd, and requested modifications to the draft ordinance to address the following:

1. allow children to stay as guests in short-term rentals in addition to not more than two adults;
2. allow a primary occupant to rent the other unit in a duplex (two-family home), and an attached apartment as a short-term rental unit; and
3. explore whether recreational vehicles (RVs) and camping (tents) in the driveway or yard area could be used as short-term rentals.

After initial consideration of the requested changes, staff has found that some of the changes requested require more time for research and ordinance drafting. In order to fully explore these items and respond to the Board's request, staff is requesting that the Board cancel the public hearing scheduled for February 23rd. Staff expects to bring a revised ordinance back for the Board's consideration by March 22nd in order to allow a public hearing to be set in April. The resolution setting a new public hearing will be provided when the revised draft ordinance is presented.
