Public Hearing on a Land Use Ordinance Amendment Relating to Road and Sidewalk Requirements

PURPOSE: The purpose of this agenda item is for the Board of Aldermen to provide an opportunity for public comment on an amendment to the Land Use Ordinance relating to road and sidewalk requirements in unsubdivided developments.

INFORMATION: On June 6, 2017, the Board of Aldermen adopted a text amendment to Article XIV, Section 15-221(b), of the Land Use Ordinance relating to road and sidewalk requirements. The amendment added a sentence to the end of Section 15-221(b) clarifying situations where the Board may reduce or eliminate the reservation and/or connection of right-of-way for Town-owned properties.

Prior to its decision, the Board requested an opportunity to have a broader policy discussion on the topic at a future meeting. The Board held this discussion on January, 16, 2018 and during its deliberations identified a minor refinement to the June 6th amendment that seemed to capture the intent of retaining bike-ped connections in those situations where vehicular connections may not be needed. A draft ordinance has been prepared that includes an additional phrase relating to bike-ped facilities (Attachment B) shown in underlined text. Article XIV, Streets and Sidewalks, is provided in its entirety for context with the final language, adopted in June 2017, for Section 15-221(b), shown in underlined text (Attachment C, page 13). Minutes from the January meeting are also included (Attachment D).

The draft ordinance was referred to Orange County, and presented to the advisory boards on June 7, 2018. Comments are provided (Attachment E).
