Continuation of Public Hearing on Land Use Ordinance Amendments Relating to Boarding Houses and Rooming Houses

PURPOSE:  The purpose of this agenda item is for the Board of Aldermen to continue to receive public comment and discuss the draft text amendments to the Land Use Ordinance relating to definitions for boarding houses and rooming houses.

INFORMATION: At the June 6th regular meeting, the Board of Aldermen opened a public hearing to receive input on a draft ordinance designed to address concerns from residents in the Lloyd/Broad neighborhood relating to the increasing size of homes and number of unrelated occupants.  A draft ordinance was presented at the meeting that clarified the definition of a boarding or rooming house in relation to both the number of rooms available to be rented as well as well as the number of unrelated individuals living in the dwelling unit.  As written these ordinance provisions would still apply to all residential occupancies.

 

The change to the definition of family has brought attention to a need for the Town to establish provisions for reasonable accommodations per the Americans with Disabilities Act.  A draft ordinance relating to reasonable accommodations has been prepared under a separate agenda item (17-608). 

 

The draft ordinance was presented at the joint advisory board meeting on May 3, 2018, and was referred to Orange County.  Comments are provided (Attachment D).  The Transportation Advisory Board decided not to submit a formal recommendation. 

 

FISCAL & STAFF IMPACT: Minimal fiscal and staff impacts are associated with the recommended action on this draft ordinance.  

 

RECOMMENDATION:r Staff recommends that the Board of Aldermen take no action on the draft ordinance at this time.
