Request-to-Set a Public Hearing on a Land Use Ordinance Amendment Relating to the Standards for Outdoor Lighting 

PURPOSE:  The purpose of this agenda item is for the Board of Aldermen to consider setting a public hearing on a text amendment to the Land Use Ordinance regarding the provisions for outdoor lighting.

INFORMATION: The redevelopment proposal at 501 South Greensboro Street (South Green) encompasses property along both sides of a public right-of-way, creating a situation whereby outdoor lighting will exceed the Land Use Ordinance limitation of 0.2 footcandles at the property line.  A draft ordinance has been prepared which, if adopted, would establish a new subsection 15-242.5(b) enabling the permit-issuing authority to allow a deviation from the footcandle standard in certain situations: a commercial or mixed-use development approved as part of a single conditional use permit, with public right-of-way extending through the project. Staff is also working on revisions to the Town’s street lighting policy to allow for the use of LED fixtures and anticipates having a draft ready for the Board’s consideration sometime in October.

 

The Board of Aldermen must receive public comment before adopting amendments to the Land Use Ordinance.  Orange County and Planning Board review are also needed.  

 

FISCAL & STAFF IMPACT: Public hearings involve staff and public notice costs associated with advisory board and Board of Aldermen review.  

 

RECOMMENDATION:r Staff recommends that the Board of Aldermen consider the attached resolution, setting a public hearing for October 23, 2018 and referring the proposed amendment to Orange County and the Planning Board.
