Approval of Revised Land Use and Building Permit Fee Waiver Policy Related to Affordable Housing

 

PURPOSE:  The purpose of the item is for the Board to approve a revised Building Permit and Land Use Fee Waiver Policy for affordable housing.

INFORMATION:  On February 20, 2018 the Board referred the Building Permit and Land Use Fee Waiver Policy (last revised on September 26, 2000) to the Affordable Housing Advisory Commission (AHAC) for their review and recommendation. The AHAC reviewed the policy in late February 2018, and recommended that the BOA move forward with approving the request to waive building and development fees for the CASA project, but requested more time to review and develop a policy recommendation.


The AHAC review found that the existing policy (Attachment A) for waiving building permit and land use fees for affordable housing did not specify where the funds would come from. They felt that the language should communicate this and they should have the opportunity to review such requests.

 

Attached is a draft policy that allows the Board to consider revised language that specifies the procedure and that the waived fees are transferred from the Affordable Housing Special Revenue fund to the General Fund. (Attachment B)

 

If the Board chooses to adopt the proposed revised Building Permit and Land Use Fee Waiver Policy, it would allow the Affordable Housing Advisory Commission the opportunity to comment on the commitment of Special Revenue Funds. Attachment C is a resolution for the Board’s consideration to adopt the policy.

 

FISCAL & STAFF IMPACT: The amount of fees can vary greatly depending on the type of housing development.  The staff impact would be minimal.

 

RECOMMENDATION:  Staff recommends the Board approve the resolution and adopt the revised affordable housing fee waiver policy.
