PURPOSE: The purpose of this item is for the Board of Aldermen to consider authorizing the Town Manager to execute a Supplemental Agreement with NCDOT and to adopt a new capital project ordinance to reflect the revised project phasing and the addition of Orange County Transit Funds.

INFORMATION: In late September, the Town received construction authorization for the first phase of the Morgan Greenway, consisting of Phase 1 and Phase 1 Alternate. The original municipal agreement with NCDOT divided the project into two phases and programed STP-DA funds for Phase 1 and TAP-DA funds for Phase 2. The engineer's updated estimate for the construction of Phase 1 is greater than the original estimate; unallocated TAP-DA funds are scheduled for rescission in September 2019. With this in mind, staff has been working with DCHC MPO staff and NCDOT to reprogram the TAP-DA funds to Phase 1 of the project. NCDOT has prepared an updated supplemental agreement reflecting this change in funding and separating the greenway into distinct projects, with Phase 1 moving forward at this time and subsequent phases requiring a new municipal agreement(s).

A new Capital Improvement Project Ordinance has been prepared that reflects the specific federal funding source (STP-DA/TAP-DA) and local match source, applying all of the project funds toward Phase 1. Approximately $200,000 in Orange County Transit funds is earmarked for the Town for this project. Staff anticipates preparing an advertisement to bid the project this winter.
