Construction Contract Authorization for the Stream Restoration Project at Public Works
PURPOSE: The purpose of this item is for the Town Council to authorize the Town Manager to execute a construction contract for the Public Works Stream Restoration Project.

INFORMATION: Following on Hurricane Florence, staff have been pursuing a stream restoration project at Public Works because of the hazardous situation associated with the unstable banks, expanding stream channel, and nearby fuel tanks and buildings. The preliminary engineering for this project, authorized per a project ordinance on June 18, 2019, has been completed by Jennings Environmental. A modification of the project ordinance to allocate an additional $265k for construction was approved on March 10, 2020. A construction bid was advertised on March 19, including advertisement through the State for Historically Underutilized Businesses (HUBs), and a bid opening held on April 16th. 5 proposals were reviewed, (including 2 proposals from HUBs [North State Environmental, Carolina Environmental, both women owned]), and the bid results tabulated (attached). It is recommended that the project be awarded to North State Environmental as the lowest cost responsive and responsible bidder.
Public Works staff continue to pursue FEMA Public Assistance funding for the project. The Public Assistance process does not obligate funding in advance, but is rather on a reimbursal basis. Therefore, Town funding is needed up front and is at risk until approved through the Public Assistance process. The Public Assistance process is time limited, so there is time sensitivity in approving this request to maximize the potential for federal funding support. There is also time sensitivity associated with moving into construction as soon as possible given the approaching tropical storm season. Staff will move forward with executing the contract and initiating work upon Council approval.
FISCAL & STAFF IMPACT: The construction contract bid amount is $139,759.98. Staff time for project coordination/oversight and pursuit of Public Assistance funding will also be needed.
RECOMMENDATION:r Staff recommends that the Council adopt the resolution (Attachment A) authorizing the Town Manager to enter into a construction contract.
